This page is primarily used to inform visitors about our policies regarding the collection, use, and disclosure of personal information.
The SOWIT SAAS refers to all SOWIT Web and Mobile applications and interfaces that deliver the SOWIT service as described in Article 2.
The service that constitutes the SOWIT SAAS, described herein and offered to the user, is provided by Sowit. By ticking the box next to the statement, « By clicking this box, you accept our Terms of Use » in the personal data registration window, the user fully accepts these Terms of Use (TOU). Sowit reserves the right to modify the TOU at any time without notice. The user can review the current TOU text at any time. Sowit may also offer additional services outside of the SOWIT SAAS, which may be governed by different terms and conditions. In such cases, these TOU do not apply to those specific services.
Sowit web and mobile applications are accessible online or offline within the SOWIT SaaS environment (Software as a Service). It is a cloud platform accessible via mobile devices or computers, providing information and decision-support tools for managing agricultural plots. The information and decision-support tools provided are not legally binding (Article 12).
The SOWIT SAAS allows users to order decision-support tools to monitor the condition of crops and enhance the quality and quantity of production. These tools aim to optimize operations and inputs using biophysical and agronomic measurements and analysis of images obtained by SOWIT. The SOWIT SAAS also processes client-provided information to offer improved services from additional perspectives, detailed in Article 4.
All collected information will be used in the client’s interest to provide tools helpful in managing their activities. Full use of the service requires an Internet connection. Sowit does not guarantee the local, temporal, or qualitative availability of the Internet infrastructure necessary for data transfer, nor does it ensure that data transfer and transmission operations can be completed within a set timeframe.
The landing pages enabling potential users to share their personal information for a callback from SOWIT to learn more are not part of the SOWIT SAAS. They only allow SOWIT to contact potential users who have consented by submitting a form on the following landing pages:
For training and quality assurance purposes, SOWIT may record phone calls with potential users. By submitting the callback form, the user consents to the recording. Users who do not wish to have their call recorded retain the right to refuse, correct, or withdraw consent. Users will be informed at the beginning of the recording to validate their consent.
To use the service, the user agrees to:
a) Provide the requested information during the registration process, ensuring it is current, complete, and truthful (« Registration Data »);
b) Promptly and continuously update the Registration Data to keep it current, complete, and truthful, if registered. If the user provides false, inaccurate, outdated, or incomplete information, or if Sowit reasonably determines that the information provided is false, outdated, or incomplete, it reserves the right to temporarily or permanently deactivate the user’s account and prevent future use of the Service.
Registration data and any other information that may be associated, directly or indirectly, with a specific user are collected and used in accordance with the European Regulation 679/2016 and Legislative Decree No. 196/2003, as amended by Legislative Decree No. 101/2018 (« Privacy Code ») and subsequent amendments and additions.
Below is information on how user data is processed, which the user explicitly accepts after careful review:
a) Data Controller: Sowit is the data controller. Users may contact Sowit’s data officer via email at contact@sowit.co
for inquiries about their personal data. Additionally, users may exercise their rights under Articles 15 to 20 of the GDPR to access, rectify, update, block, limit, delete, or request portability of their personal data by using the same email address. Individuals also have the right to have their data erased under one of the six conditions described in Article 17 of the GDPR.
b) Purposes of Data Processing: Registration data collected by the SOWIT SAAS, through automated and non-automated tools, may be used for the following purposes:

c) Consent Withdrawal: Users can withdraw their consent for promotional activities at any time, which will prevent further promotional contact. However, this withdrawal does not affect data processing essential to service provision.
d) Third-Party Communication: Certain data may be shared with third parties or partners for the purposes stated above (ii), particularly those directly involved in providing or improving the service.
Data provided outside the registration circuit (such as guest mode data) related exclusively to plots—like location or geometry—are considered non-identifiable under these TOU.
After completing the registration process, users receive an exclusive account (« Username or User ID ») and a confidential password. Users are solely responsible for the confidentiality of these credentials, including any activities conducted using them.
Users must immediately notify Sowit of any unauthorized use of their password or account and any other security breaches they discover. Sowit is not liable for damages resulting from non-compliance with this provision.
Authentication for accessing the service relies solely on the verification of the Username and Password. Users are responsible for their correct use and any resulting consequences for Sowit or third parties due to misuse, loss, or theft of these credentials.
Usernames and passwords must only be shared with employees authorized to use them for work purposes. Any misuse of credentials must be reported immediately to Sowit for deactivation.
Sowit guarantees the confidentiality and security of user-uploaded data but is not responsible for the accuracy or compliance of entered data. Data may be processed internally or by third parties under applicable laws.
Sowit retains data for statistical and scientific purposes to improve its services. Upon user request, data will be deleted, except for cases where processing is legally justified. Sowit will anonymize or pseudonymize data used for statistical or functional purposes.
While Sowit employs commercially acceptable security measures, absolute security cannot be guaranteed due to the nature of online data transmission and electronic storage.
The service provides a non-exclusive right to access SOWIT SAAS for personal use only. Users may not sell, copy, or redistribute the service. Even for free services, these provisions apply.
The service must be used strictly within the limits outlined in these TOU. Users must not access, copy, or use the service in unauthorized ways or infringe upon intellectual property rights.
Sowit is the publisher of SOWIT SAAS. All content within the platform is protected by international copyright and database rights. Users are prohibited from extracting, modifying, or redistributing any content without Sowit’s written consent.
Similarly, users are forbidden from reverse-engineering, creating derivative works, or transferring any rights related to the platform to third parties. Accessing the service via unauthorized means is strictly prohibited.
The user acknowledges and agrees that Sowit, at its sole and exclusive discretion, may deactivate the user’s password and account or interrupt the use of the service if it determines that the user has violated or acted in a manner incompatible with or contrary to these TOU. The user acknowledges and agrees that any suspension or interruption of access to the service under these TOU provisions may occur without prior notice.
In the event of service interruption, termination, or suspension due to force majeure, Sowit will make every effort to preserve records and enable their restitution to the user, without assuming any charge or obligation in this regard.
The user explicitly agrees that Sowit may interrupt service usage in the following cases:
The SOWIT SAAS may contain links to other websites, applications, or services offered by third parties. A link to a third-party service does not imply Sowit’s endorsement or affiliation. Sowit has no control over third-party websites, their content, or the policies they adopt in delivering their services. Access to such third-party sites or content is at the user’s own risk.
Sowit recommends that users always read the terms of use and privacy policies of third-party websites before using them. Sowit shall not be liable for any damage or loss related to the use of any content, product, or service available on or through a third-party website, mobile application, or web application.
These TOU apply for the entire duration of the service use, beginning with the first use of any Web or Mobile application within SOWIT SAAS and continuing as long as the user accesses these applications.
Access rights granted to users do not provide any entitlement to the original source code. All techniques, algorithms, and procedures contained within SOWIT SAAS and related documentation are protected by copyright and are the property of Sowit. They cannot be used for any purpose other than those explicitly stated in the TOU.
The user acknowledges and agrees that Sowit shall not be held responsible for damages of any kind, including but not limited to loss of profits, business goodwill, or data, resulting from:
Sowit disclaims all liability concerning the application of Decision Support Tools (DSTs). While these tools are designed to assist users in increasing profit margins, their implementation—whether partial or full—does not guarantee financial or non-financial gains. The ultimate decision-making responsibility lies with the user, not SOWIT SAAS. Any benefits presented to the user are based on statistical use cases and hold no contractual value.
Sowit and its associated services may only be used by individuals aged 18 or older. Sowit assumes no responsibility for service usage by minors.
Sowit shall not be held liable for failure to meet its obligations if it can demonstrate that:
Examples of « force majeure » include, but are not limited to: natural disasters, fires, floods, wars (declared or undeclared), civil unrest, riots, embargos, sabotage, accidents, pandemics, labor disputes, strikes, actions of public or governmental authorities, or any similar occurrences.
In case of force majeure, the affected party (« The Defaulting Party ») will notify the other party of the event and its effects. The parties will then work together to minimize the event’s impact. During the force majeure period, the Defaulting Party is not held responsible for the inability to fulfill its obligations.
All communications between parties must be in writing and, unless otherwise stated in the TOU, can be sent via certified email, regular mail, or simple email to the address provided during registration (support@sowit.co
).
Sowit may notify users of TOU changes or other matters via general user notices, email, or links to such notices. Users are encouraged to review this page periodically for updates. Changes will take effect immediately upon being posted on this page.
These TOU and the relationship between Sowit and the user are governed by the laws of the French Republic. For any disputes arising from or related to these TOU or the use of the service, the courts of Paris shall have jurisdiction, following an attempt at conciliation through a state-accredited organization.
These TOU constitute the sole and exclusive agreement between the user and Sowit and govern the use of the service, superseding any prior agreements. Sowit’s failure to exercise its legal or TOU-provided rights does not constitute a waiver of such rights.
If any provision of these TOU is deemed invalid by a competent court, the remaining provisions remain effective. If two provisions conflict, Sowit reserves the exclusive right to determine which applies.
